Siân Westby

Siân is a property litigation solicitor who has acted for a wide range of clients including commercial landlords and tenants, mortgage lenders and receivers.

Siân has experience advising clients on a variety of property issues: all aspects of landlord and tenant litigation including dilapidations, lease renewals and forfeiture; boundary disputes; adverse possession; actions against trespassers and easements. Siân also acts for commercial landlords in pursuing claims for rent arrears and possession proceedings.

Siân’s experience includes advising:

• A park holiday business on enforcing positive covenants against successors in title. This case involved the issue of over 150 claims, two first instance trials, mediation and successfully opposing an appeal at the Court of Appeal (Wilkinson & Others v Kerdene Ltd [2013] EWCA Civ 44);

• A major charitable organisation on various property matters including adverse possession, trespass and obtaining injunctive and declaratory relief;

• A marine business on obtaining possession of various berths and taking liens over property;

• Receivers on matters arising in conjunction with the disposal of properties including trespass, possession, variation of leases, licences and lease renewal proceedings.

Siân completed her training with Shoosmiths LLP and qualified in 2009 before joining Land Law LLP in April 2017. Siân is a member of the Property Litigation Association.
