Deeds Of Easement & Wayleaves

Deeds Of Easement & Wayleaves

Our specialist team provides extensive and professional advice to land owners, occupiers and developers whose properties and development sites are affected by existing or proposed electricity cables, gas pipelines, water pipes, sewers and telecommunications apparatus. We also advise private utilities companies on the grant of easements for surface water and trade effluent drainage from land into canals and rivers.

Our dedicated litigation team deals with contentious matters including interpreting existing legal agreements and advising on prescriptive easements. With the government’s objective to facilitate better infrastructure and with the upcoming HS2, wayleaves and easements will become more relevant and it is imperative that each case is properly considered to minimise the effect on future development and use of the property.

Examples of the type of work carried out are:

  • Dealing with the grant of easements and wayleaves to statutory providers of utilities and telecom networks to run pipes and cables along, under or over land.

  • Negotiating bespoke utility and telecoms easements and wayleaves for high end residential and commercial development sites;

  • Interpreting existing legal agreements and advising on the implications for development and options for diversion where possible;

  • Acting for both landlords and tenants to negotiate wayleaves for the installation of telecommunications apparatus including advising on the implications for the tenant on vacating the property or terminating their lease pursuant to a break option.
